For the operation of this e-commerce website and the fulfillment of our services, the following entities act as Joint Controllers in accordance with Art. 26 GDPR:

Division of Responsibilities as Joint Controllers:
To ensure the protection of your personal data, we have entered into a Joint Controllership Agreement. The responsibilities are divided as follows:

Hoymiles MyEnergy GmbH is responsible for the legal and commercial operation of the store in the EU, managing local compliance, and acts as your primary point of contact for asserting your data subject rights.     

Hoymiles Power Electronics Inc. provides and operates the IT infrastructure of this website and executes the operational tasks regarding shipping, customer inquiries, and after-sales services on behalf of the joint operation.

Regardless of this internal division of responsibilities, you may exercise your rights under the GDPR against either of the joint controllers.

2 DATA TYPES & LEGAL BASIS

2.1 In principle, most of our Services can be used without creating an account or sharing personal data with us. However, this may lead to reduced functionality of the Service.

2.2 Depending on how you communicate with and use our Services , the amount of personal data we collect, process, and use will vary. Within our website, we will collect, process, and use personal data about you, particularly in the following cases:

  • b. When you voluntarily contact us by email or correspond directly with us.
  • c. If you register a website account to use or communicate with our website.
  • d. If you order, or purchase a Hoymiles product. 
  • e. If you request product maintenance or service from us or our authorized service partners, or make an appointment for such services.

  • g. If you apply for a loan or financing solution offered by our partners.
  • h. If you sign up for our newsletter or participate in our surveys.
  • i. When there is a legal obligation or to defend legal claims.

Please note that, where certain personal data is required to access a function or service, we will indicate which fields are mandatory and explain the consequences of not providing them.

In other cases, we may collect information passively, as we may use tracking tools like browser cookies and other similar technology on our website and in communications we send you.

2.3 We will process the following categories of personal data, depending on how you interact with us :

  • a. User contact data, such as first name, last name, address, telephone number, and email address;
  • b. User account data, such as email address, password, account ID, username, user ID, country/region setting, etc;
  • c. User consent records, such as user ID, account ID, the consent time, related policy version information,etc;
  • d. Technical, security and account operations data, such as IP address (used for security logs and fraud prevention), login tokens, digital certificates, verification codes, and essential system/app crash logs;
  • e. Tracking, analytics, and advertising data (typically collected via cookies and similar technologies), such as browser type, browsing behavior on our website, IP-based approximate location, and advertising identifiers (e.g., IDFA, GAID) or cookie IDs;
  • f. Order information, such as delivery address, order status, company, VAT number, delivery status;

  • h. Feedback data, If you contact us to provide you with information about products or if you request support or data subject right response;
  • i. Review data, such as username (de-identified), country, comment contents ( which may include the photo you uploaded) and comment time;
  • j. Marketing preference and subscription data, such as newsletter subscription status, communication preferences, marketing consent records and opt-out records.

2.4 We may use data that we collect for the following purposes:

2.4.1 Performance of the agreement (Art. 6(1)(b) GDPR) in the context of the provision of our website Services:

  • a. Processing of the order on the website.
  • b. Processing of applications related to the purchase on the website, such as your application for a loan or financing.
  • c. Delivery of our website services to you, such as website Account, website events, and other related services and features.
  • d. Handling of service and maintenance requests, such as appointments and requests regarding service, repair, and warranty.
  • e. Processing of your accounts and invoices.
  • f. Provision of customer support, such as answering requests via online chatting, phone calls or emails.

2.4.2 Compliance with statutory obligations (Art. 6(1)(c) GDPR) to which Hoymiles is subject:

  • b. When your request is related to the exercise of your rights on which we inform you below, we are legally permitted to process your data for compliance with our legal obligations.

2.4.3 Based on your freely given consent (Art. 6(1)(a) GDPR)

  • a.When you subscribe to our Newsletter service, we will offer you the latest news about our products and services.
  • b.We will use your personal data such as browsing history, and purchase history collected from our website cookies to build a profile about your preferences. This allows us to show you personalized advertisements on third-party platforms and enrich your profile with data from our partners to better understand your interests. You can check and change your current browser's cookie settings using the methods below.
  • c.When you post a review for a purchased product, we process your personal data, including your de-identified username, country, comment content (which may include uploaded photos), and the timestamp of your submission. You retain full control over your content and may delete your review at any time.
  • d.We will use your personal data such as your IP address, browser information, and interactions with our website in order to evaluate website usage, compile statistical reports, and continuously improve our Services. This processing only occurs if you have actively opted-in, and you can check and change your current browser's cookie settings using the methods below.

2.4.4 Based on the legitimate interests of us or a third party (Art. 6(1)(f) GDPR), as specified below:

  • a. Improving our products and services. We may anonymize and aggregate the personal data we collect (so that it does not directly identify you) to better understand how our Services will be used, to improve our Services , and to develop new features and services. 
  • b. Providing user support, such as requests regarding our products or services that we receive via online chat function, telephone, or email.
  • c. To ensure website information security. Collected data is processed in the context of ensuring the operation of IT systems. This includes, but is not limited to, backup and recovery of data processed in IT systems, recording and verifying the proper functioning of IT systems, detection and defense against unauthorized access to personal data, and incident and problem management to remedy disruptions in IT systems.

3 HOW WE SHARE YOUR DATA

3.1 We may share your data with the following parties:

a.Hoymiles Group Companies and/or Hoymiles Affiliated Companies. Depending on which Hoymiles Service you use, we may share your personal data with other Hoymiles Group Companies and/or Hoymiles Affiliated Companies to provide the Service to you. For example, when another Hoymiles entity performs the Service for you (e.g. providing after-sales warranty support) that you requested via the Hoymiles Website.

b.Service providers and advisors as our data processor. Personal data may be provided to external suppliers and other service providers who perform services on our behalf or perform services as an independent controller, including identifying and delivering targeted advertisements (for example on Facebook and Twitter), offering website infrastructural services, offering payment services, mailing or email services, customer support, after-sales and maintenance, tax and accounting services, fraud prevention services, web hosting, logistics, transport and delivery partner, and analytical services.

c.Payment service providers, To process your payments securely, we offer various payment methods. When you make a purchase, your payment data is transferred to the respective payment service provider. These providers act as independent Data Controllers for the processing of your payment information. We do not store your full credit card details or payment credentials.

  • PayPal: If you choose PayPal, your data is transmitted to PayPal (Europe) S.à r.l. et Cie, S.C.A. 
  • Klarna: If you choose Klarna's payment options (e.g., Pay Later), we will transmit your personal and order details to Klarna Bank AB (publ) so Klarna can assess whether you qualify for their payment methods and tailor those methods for you.
  • Shopify Payments: If you pay via credit card using Shopify Payments, your payment is processed by Shopify International Limited (and its technical partners, such as Stripe). 

d.Law enforcement agencies, regulators and other parties for legal reasons. Personal data may be provided to third parties as required by law or if we reasonably believe that such action is necessary to (a) comply with the law and reasonable requests from law enforcement agencies; (b) protect the security or integrity of the Service; (c) exercise or protect the rights, property or personal safety of us, our employees, users of the Service, or the general public; and/or (d) establish or substantiate legal claims of us.

e.Buyers and third parties in connection with a business transaction. Personal data may be provided to third parties in connection with a transaction, such as a merger, sale of assets or shares, reorganization, financing, change of control, or acquisition of (part of) our business.

4 HOW WE KEEP YOUR DATA

The time for which we will keep your data will depend on the purposes for which we process them, as explained below:

4.1 We will keep your personal data only for as long as necessary for the purposes we collected it, including for the purpose of complying with legal requirements, accounting, or reporting obligations.

4.2 We will determine the appropriate retention period for personal data based on the nature,  sensitivity of the personal data, the potential risk of harm resulting from unauthorized use or unauthorized disclosure of your personal data, the purposes for which we process your personal data and the possibilities of achieving these purposes in another way, and the applicable legal requirements.

  • a.Personal data processed by us for the performance of an agreement will be retained for as long as your agreement has not been terminated, and after termination of the agreement, we generally retain your personal data for 6 to 10 years to comply with liability requirements and statutory retention obligations.
  • b.Personal data that we process in connection with your purchase of goods and/or services from us. We generally retain your personal data for 6 to 10 years to comply with liability requirements and statutory retention obligations.
  • c.For after-sales service, maintenance, and/or warranty requests for products, we generally retain your personal data for 10 years to comply with requirements regarding liability, product conformity, and responsibility.
  • d.Personal data processed for direct marketing is retained until you withdraw your consent or object to the processing, at which point it will be promptly deleted or restricted from further use.
  • e.Routine customer support inquiries and general communications through Emails, Hotline and Online Chat are generally retained for 1 to 3 years after the respective request has been resolved. Notwithstanding the above, communications that qualify as commercial letters or are relevant for tax purposes are subject to strict statutory retention obligations under German law (e.g., the German Commercial Code and the Fiscal Code) and will be securely retained for 6 to 10 years.
  • f.We may retain this data for a longer period, as mentioned earlier, if we believe that such data may be necessary for investigating, defending, or initiating criminal prosecution of you, us, or a third party, or in the event of any claims.

5 DATA STORAGE AND TRANSFER

5.1 Your personal data is primarily stored in the EU/EEA, but may be accessed or processed outside the EEA. We take appropriate technical and organizational measures to protect your personal data against accidental or unlawful destruction, loss, alteration, or damage. All personal data that we collect is stored on secure servers.
 
5.2 Your personal data may be transferred to, processed and stored in, countries outside the jurisdiction in which you are located and in which we and our third-party service providers or other entities of the Hoymiles Group operate. If you are located within the EEA, your personal data may be processed outside the EEA, including, but not limited to, the US or China (an "International Transfer"). Any International Transfer of your personal data will take place: 

  • a.to a country or territory that ensures an adequate level of protection for the rights and freedoms of data subjects in connection with the processing of personal data as determined by the European Commission;
  • b.to a third party participating in a compliance scheme recognized as providing adequate protection for the rights and freedoms of data subjects as determined by the European Commission; or
  • c.on the basis of appropriate safeguards, such as the Standard Contractual Clauses approved by Decision of the European Commission. In such cases, we inform you that we transfer your data with adequate safeguards and always keeping your data safe, using appropriate international data transfer mechanisms, for example the Standard Contractual Clauses with comprehensive transfer impact assessment and any relevant supplementary measures. 5.3 Outside of the aforementioned cases, and only in exceptional or specific situations, an International Transfer may occur based on your explicit consent (Art. 49(1)(a) GDPR). If we rely on this derogation, we will inform you separately in advance about the details of the transfer and the possible risks associated with such transfers due to the absence of an adequacy decision and appropriate safeguards.

6 YOUR RIGHTS

You have the following rights in relation to your data and our processing of your data:

  • a.Right of access. To request access to your personal data that we hold.
  • b.Right to data portability. When we are legally permitted to process your data due to your consent or to for the purposes of a contract, as explained in section 2, you will also have the right to request the portability of your personal data. This means that you will have the right to receive the personal data that you made available to us in a structured, commonly used and machine-legible format, to be able to transmit them to another entity directly without impediments on our part.
